is a military survivor benefit plan (SBP) case we litigated before the Supreme Court of Virginia after having won a decision on behalf of our client in the Circuit Court of Fairfax County. The Supreme Court ruled in favor of our client finding that Federal law (10 U.S.C. §1450(i)), which states an SBP annuity is not subject to execution, levy, attachment, garnishment or other legal process, trumped the ability of a Virginia state court to impose a constructive trust on the benefits being paid to our client because a constructive trust qualifies as a legal process which the Federal statute explicitly forbids.
